Residents Shocked by Sudden Eviction Notices

Tensions remain high in Komani after residents occupying old Transnet-owned buildings along Queens Drive, locally known as “Bretse,” were served eviction notices on Wednesday, 14 January. A private security company reportedly delivered the notices, instructing occupants to vacate the premises by 3pm the same day.

Residents said they were caught off guard and questioned the legitimacy of the notices, insisting they received no prior warning or clear explanation about the eviction. Many families remain on the property and have refused to leave under the current circumstances.

Document Links Action to Transnet Property

A document shared with Komani News appears to be a Power of Attorney issued by Transnet Property on 14 January 2026, signed in Pretoria. The document authorises a private legal entity to act on behalf of Transnet Property in eviction matters and related administrative actions. It references Transnet SOC Ltd as the property owner and outlines authority to engage local authorities and handle applicable fees.

Despite this, it remains unclear whether the eviction notices form part of a formal, court-approved process. Residents report that no court order was presented to them, which is required under South African law for any eviction.

Legal Process Must Be Followed

South African law mandates that evictions follow strict legal procedures, including court oversight and consideration of the rights of occupants. At this stage, neither Transnet Property, nor law enforcement have provided official confirmation about the incident.

Community Concern Grows

The situation has raised concern in the wider Komani community, with residents calling for proper engagement from authorities. Many emphasise that sudden eviction attempts can create confusion and anxiety, particularly for vulnerable residents.

Situation Still Developing

As of Friday, 16 January, residents remain on the premises. No physical removals have taken place, and occupants say they are prepared to resist any attempts to force them out without following due legal process. The situation is being closely monitored by local residents and observers.
