Komani Attorney Wesley R Hayes Triumphs in Landmark Mandela Legacy Case
Komani, Eastern Cape – Wesley R Hayes, a prominent attorney based in Komani, has played a pivotal role in a historic Supreme Court of Appeal (SCA) ruling that cleared the way for Nelson Mandela’s personal items to be auctioned internationally.
The victory marks the conclusion of a four-year legal battle against the South African Heritage Resources Agency (SAHRA), which had attempted to block the sale of Mandela’s memorabilia.
The case involved Mandela’s eldest daughter, Dr Makaziwe Mandela, and her daughter Tukwini Mandela, alongside Mandela family friend Christo Brand, who collectively sought to auction items including Mandela’s iconic floral shirt, a broken Robben Island prison key, and a pen gifted by former US President George W. Bush.
The auction is intended to fund a memorial garden in Qunu, Mandela’s childhood home.
In a social media post, Wesley R Hayes expressed his relief and pride in the outcome: “After 4 years of working on this matter for my clients, Dr Makaziwe Mandela and her daughter Tukwini Mandela, with my best friend and colleague Adv David Smith, I am so proud and relieved we won this historic case in the Supreme Court of Appeal today.”
The SCA ruled that SAHRA could not claim the items as protected heritage objects without clear legal justification.
The court emphasised that Mandela’s family had the constitutional right to manage and dispose of his personal property.
Hayes, alongside Advocate David Smith, guided the Mandela family through this complex legal process, asserting that the government’s repeated attempts to block the auction were unnecessary and costly to taxpayers. “The victory in this one against our greedy government is sweet!” Hayes wrote.
Dr Makaziwe Mandela expressed gratitude to Hayes and his team for their dedication, stating that the auction proceeds would go toward creating a “fitting living Garden of Remembrance” to honour Mandela’s legacy and social justice work.
