Sterkspruit Uncle Sentenced to Life for Rape of 10-Year-Old Niece
EASTERN CAPE – The Sterkspruit Regional Court has delivered a decisive judgment against child abuse, sentencing a 43-year-old man to life imprisonment for the rape of his 10-year-old niece. The sentencing serves as a stark warning to perpetrators of gender-based violence, particularly those who abuse positions of familial trust.
Abuse of Trust and Silence
The incident occurred in October 2023, shortly after the young victim had returned home from soccer practice. According to evidence presented in court, the child was watching television when her uncle arrived at the homestead.
The accused, who was under the influence of alcohol, summoned the child to his rondavel, situated within the same yard. When the child refused his sexual advances, he overpowered her, forcibly undressed her, and raped her.
Following the assault, the uncle weaponized the child’s fear, threatening to kill her or banish her from her home if she disclosed the abuse.
The Discovery
The crime remained hidden due to the victim’s terror, despite immediate physical consequences. On the night of the assault, the child suffered severe stomach cramps and vomiting. Days later, her mother noticed she was limping.
While a visit to a local clinic confirmed that the child had been sexually penetrated, she remained too afraid to name her attacker. The truth only surfaced when a concerned neighbour intervened. Through gentle questioning, the neighbour created a safe space for the child to finally disclose the horrific ordeal, leading to the immediate arrest of the uncle.
The Trial and Judgment
During the trial, the accused maintained a “bare denial,” insisting he had not committed the crime. However, the State, led by Prosecutor Anele Magibile, presented a watertight case.

Prosecutor Magibile argued that the accused had grossly abused a position of authority. He highlighted the brutality of the assault and the calculated threats used to silence the child as evidence that the accused posed a continued danger to society. The court agreed, convicting the man of rape and imposing the maximum sentence.
Raction from the NPA
Mr. Barry Madolo, the Eastern Cape Director of Public Prosecutions, welcomed the sentence as a victory for the most vulnerable members of society.
