Man Sentenced to 25 Years for Raping 10-Year-Old in Sterkspruit

STERKSPRUIT – A 35-year-old man has been sentenced to 25 years’ direct imprisonment after being convicted of raping a 10-year-old girl in Palmietfontein, Sterkspruit, in a case that has once again highlighted the vulnerability of children and the harsh realities of sexual violence in South Africa.

Bongani Mraca was sentenced by the Sterkspruit Regional Court following his guilty plea to the charge of rape. The offence occurred on 30 July 2023, when the young victim went to Mraca’s home to play with his nephew and another child.

According to evidence presented in court, Mraca was alone at the house at the time. He deliberately separated the victim from her friends by sending the other children to a nearby spaza shop. Once the child was left alone with him, he raped her.

The traumatised child later reported the incident to her mother, who immediately alerted the authorities. Police acted swiftly, and Mraca was arrested at his home. The matter was thoroughly investigated, leading to his eventual prosecution and conviction.

During sentencing proceedings, State Prosecutor Anele Magibile stressed the seriousness of the crime, describing rape as a violent and degrading act that strips victims of their dignity and violates their constitutional rights.

The court placed strong emphasis on the fact that the victim was a child, noting that children are among the most vulnerable members of society and require the highest level of protection under the law. The magistrate reiterated that the best interests of the child are of paramount importance in all matters concerning minors.

Although the court acknowledged that Mraca had pleaded guilty and was a first-time offender, it ruled that these factors did not amount to substantial and compelling circumstances that would justify a lesser sentence. The court found that the severity of the crime, the age of the victim, and the abuse of trust far outweighed any mitigating factors.

In addition to the 25-year custodial sentence, the court declared Mraca unfit to possess a firearm. It also ordered that his name be entered into the National Register for Sexual Offenders, a move aimed at preventing him from working with or having access to children in the future.

Welcoming the sentence, Eastern Cape Director of Public Prosecutions, Mr Barry Madolo, said the outcome sent a strong message to perpetrators of sexual offences, particularly those who prey on children.

“This sentence sends a clear message that sexual offences against children will not be tolerated. The National Prosecuting Authority remains committed to ensuring that perpetrators are held accountable and that justice is served for the most vulnerable members of our society,” Madolo said.

He further commended the investigative work of Detective Sergeant Simelani, whose efforts played a crucial role in securing justice for the young victim.

The National Prosecuting Authority (NPA) reiterated its unwavering commitment to protecting children and prosecuting those who commit sexual offences. It emphasised that justice for victims remains a top priority and that prosecutors will continue to ensure that offenders face the full force of the law.

Authorities have again urged communities to remain vigilant and to report any suspected abuse immediately, stressing that early reporting can prevent further harm and help bring perpetrators to justice.
