Two Apartheid Police Officers Convicted of 1987 Murder of COSAS Activist Caiphus Nyoka

Pretoria High Court Delivers Justice Decades Later in Landmark Apartheid-Era Case

PRETORIA, SOUTH AFRICA — The Pretoria High Court, sitting in Johannesburg, has delivered a decisive verdict in a decades-old murder case, finding two former apartheid-era police officers guilty of the premeditated murder of student activist Caiphus Nyoka in 1987.

Former Sergeants Abraham Hercules Engelbrecht (61) and Pieter Stander (60) were convicted following a trial that revisited the violent suppression tactics used against the anti-apartheid movement. Nyoka was a member of the Congress of South African Students (COSAS).

The Planning and Execution

The court found that Engelbrecht and Stander, who were members of the notorious Reaction Unit within the South African Police Service (SAP), planned the killing on the evening of 23 August 1987.

• The Plan: They met to discuss a plan, devising a raid on Nyoka’s home.

• The Attack: In the early hours of 24 August 1987, at approximately 02:30, the two sergeants, along with other members of the Reaction Unit (who are charged separately), stormed Nyoka’s room.

• The Murder: After identifying Nyoka, who was sleeping with three friends, they removed the friends from the room. Engelbrecht and Stander then proceeded to shoot him nine times. Nyoka died at the scene from multiple gunshot wounds.

The Trial and Acquittal

During the trial, the State called five key witnesses, including Nyoka’s two sisters, Alegria and Mothasi Nyoka, and one of the friends present on the night of the incident, Gugulakhe Exodus Nyokane. Crucial expert testimony was provided by TRC researcher Dr. Rousseau.

A significant point in the trial was the failed Section 174 application brought by the defense after the State closed its case, where the accused claimed the prosecution had no case to answer. The court dismissed this application.

In delivering the judgment, the court ruled that the State was able to prove its case against Engelbrecht and Stander beyond reasonable doubt.

However, the court acquitted the former commanding officer, Major Leon Louis Van Den Berg (75), on all charges.

NPA Response and Next Steps

The National Prosecuting Authority (NPA) welcomed the judgment against the two former sergeants, stating the outcome is encouraging and a step toward providing justice for the Nyoka family.

NPA Regional Spokesperson Lumka Mahanjana confirmed the NPA will study the judgment carefully in respect of the acquittal of Major Van Den Berg.

The matter has been postponed to 11 December 2025 for the bail application of Engelbrecht and Stander, pending their formal sentencing. The two remain remanded in custody.
