Eastern Cape Education Department warns against unlawful school closures

The Eastern Cape Department of Education has condemned what it described as the unlawful closure of schools by some School Governing Bodies (SGBs), warning that those responsible could face serious consequences, including possible legal action.

In a media statement issued on 14 May 2026, Head of Department Sharon Maasdorp said the department had noted with concern recent incidents where schools were allegedly shut down by SGBs seeking the department’s attention over various issues.

Maasdorp said the closures disrupted teaching and learning and compromised valuable teaching time for learners. She added that the department remained open to engaging stakeholders through official channels.

“All departmental managers are available to openly engage all our stakeholders on all issues pertaining to education,” she said. “Despite that, protecting the Constitutional right of every school-going age learner of access to education is paramount to us.”

The department said it would act firmly against anyone involved in illegally disrupting schooling.

According to the statement, the department could invoke its powers against SGBs found to have acted outside their mandate, including possible litigation against individuals responsible for disrupting schools.

Maasdorp further stated that unlawful school closures violated both the Basic Education Laws Amendment Act (BELA Act) and the South African Schools Act.

She warned that only the MEC, the Head of Department or a court had the authority to close schools legally.

“We therefore call for restraint, because while everyone has a right, there are responsibilities also expected,” Maasdorp said. “Anyone else doing such may face serving a jail term.”

The department called on communities, parents and other education stakeholders to use proper channels to raise concerns rather than interrupting schooling.
